The claimant had been an inpatient at Maidstone Hospital for several months when, during a period of snowy weather, she slipped on some melted snow on the ward. She suffered a suspected fracture of the right scaphoid and was put in plaster. She remained in plaster for several weeks and experienced pain and discomfort as a result.
We were instructed under a conditional fee agreement (no win/no fee) and having written a letter of claim, the NHS admitted breach of duty. A medical report was obtained from a consultant orthopaedic surgeon who specialised in upper limb injuries. He confirmed that the claimant had suffered a soft tissue injury in her right leg and wrist. The claim was valued and we put forward an offer of settlement which was accepted by the defendant.
