    The clinical negligence team demonstrated their expertise when they recently recovered damages for a patient who suffered post traumatic stress disorder after receiving a malaria medication overdose due to a prescription error. The case settled for a six-figure award plus legal costs.

    Jonathan Herbert acted for Miss M who suffered damages when doctors at Frimley Park Hospital failed to give a proper dose of medication for malaria having taken advice from the Hospital of Tropical Diseases.

    Miss M who was 47 at the time, was diagnosed with Malaria after a short period of illness following a holiday abroad. Miss M fell so ill that she was admitted to hospital one evening. In the early hours of the following morning advice was taken from the Hospital of Tropical Diseases but their advice was misunderstood and instead of giving two different drugs consecutively and over time, they were given together and one at a dangerously high level. Before she finished taking all but a couple of the tablets, a doctor rushed in and prevent her taking any more.

    Miss M described alarms going off before being surrounded by doctors and nurses. She panicked and felt short of breath. Miss M was told that her heart was out of rhythm because of the overdose and because of that, that the doctors needed to stop and restart her heart.

    Miss M suffered Post Traumatic Stress Disorder

    Advice taken from Guy’s Hospital’s Poison Unit was acted on and Miss M’s condition stabilized without any action being taken to stop and restart her heart. Unfortunately, Miss M developed Post Traumatic Stress Disorder and a co-morbid depressive episode which resulted in a number of symptoms and which prevented her from working. Miss M confirmed that she had become a completely different person from the outgoing hard worker she was before.

    The cost of therapy was sought in the hope that it would help Miss M recover as best possible her previous level of functioning. As the case progressed towards trial, settlement negotiations took place which concluded with a settlement for an undisclosed 6-figure award plus legal costs.
