    This case study demonstrates the expertise of our Clinical Negligence team who recovered £15,000 for a lady who suffered avoidable pain and suffering following a failure to diagnose and treat a partially ruptured Achilles tendon.

    Our client already suffered with tendonitis but after experiencing sudden pain that was markedly different to what she had experienced before, she went to Eastbourne Hospital's Emergency Unit that day and five days later complaining of pain. The outcome on each occasion included her being discharged to her GP with advise to rest, elevate her foot ('RICE') and to take anti-inflammatory medication.

    Unfortunately, about ten weeks later, she suffered a complete Achilles tendon rupture but despite attending hospital again, the injury was not diagnosed for nearly four more months, despite a review after three weeks when it was suspected that she had suffered a partial rupture or a healing ruptured Achilles tendon with an MRI scan being requested.

    Upon our involvement, the hospital admitted that our client should at the very least, on her second and third attendances at hospital, have been referred to a review clinic and possibly even referred to their orthopaedic team for further investigation and management. Had this happened, our client would have been given conservative treatment initially but the ruptured tendon would inevitably been diagnosed much earlier thereby sparing her from prolonged pain and suffering; deterioration of condition; increased and prolonged loss of mobility that impacted upon her ability to work and drive, and ultimately secured a better outcome overall.

    Our client was pleased with the outcome.
