    James Cahan, specialist clinical negligence lawyer based at Thomson Snell & Passmore’s Tunbridge Wells Office, has secured £50,000 for a client who had expressly wished for ‘no foreign materials’ to be left in his body following surgery.

    The claimant was a gentleman who required pectus excavatum surgery at Norfolk and Norwich Hospital.  This is a deformity to the chest wall in which several ribs and the sternum grow abnormally, causing the chest to appear caved in or sunken.

    During the course of the procedure the claimant was to have metal ravitch bars temporarily inserted into his chest, which were to be removed during a second operation once the chest had reformed.  The claimant made it clear that he did not want any foreign materials (including metalwork) to be left in his body permanently as he was concerned about heavy metal allergies.

    After the surgery the claimant had a number of unusual symptoms. The claimant requested his own medical records and saw that he had several foreign objects in his chest on x-rays, which turned out to be titanium clips.    
    The claimant paid privately for three invasive surgeries to have the clips removed as they had become embedded in his ribs.  These operations in turn led to additional problems with chest instability and pain.

    We were able to obtain £50,000 for the claimant in relation to the pain and suffering caused by the three surgeries to remove the clips, due to the failure of the defendant to take account of his express wishes for no foreign materials to remain in his body.
