    This case study demonstrates the expertise of our Clinical Negligence team who recently negotiated a settlement of £15,000 for a woman who suffered a muscle wastage injury as a result of a failure by doctors at Bedford Hospital to diagnose and treat significant lesion of the knee.

    The claimant attended the Accident and Emergency department of the Bedford Hospital on the 6th December 2005 with an injury to her knee.

    One month later, she was still in significant pain, was unable to weight-bear and had limited movement in the knee. An assessment on the 31st January 2006 confirmed an inability to straighten the leg. An urgent arthroscopy and examination under anaesthetic was arranged and took place on the 2nd February 2006.  

    There was a failure to carry out a thorough examination of all compartments of the knee joint and make a correct diagnosis of a significant lesion and her condition.

    Due to the failure to diagnose and deal with the lesion the claimant continued to experience significant symptoms between February 2006 and 22nd May 2006. Had there been a proper examination of the claimant's knee the scar tissue would have been removed.  

    During the above period, she continued to limp and remained in pain. She was unable to straighten her leg, drive or walk more than a couple of hundred yards and was suffering muscle wastage of the thigh and calf as a consequence.

    Her symptoms persisted and she underwent a further arthroscopy on the 22nd May 2006 including excision of the partial suprapatellar septum, excision of the medial plica, excision of the scar/haematoma from the fat pad and notchplasty and chondroplasty of the patella.

    Intensive physiotherapy was recommended to work on extension of the knee. She subsequently underwent a course of physiotherapy and her condition gradually improved.  

    The claimant instructed us to investigate and we were able to act for her under a Conditional Fee Agreement (no win no fee). Settlement was negotiated the claimant received £15,000.
