    Jonathan Herbert, specialist clinical negligence lawyer based at Thomson Snell & Passmore’s Tunbridge Wells and Dartford (Thames Gateway) offices, has secured £7,000 for a woman who required additional corrective incisional hernia repair due to insufficient examination in theatre during the first repair.

    The claimant in this medical negligence claim was a 47 year old woman from Crowborough, East Sussex who had undergone a laparoscopic incisional hernia repair with the placing of a dual layer mesh to the left of the mid line at Maidstone Hospital. This was a post-splenectomy (removal of the spleen) hernia identified to be in the medial aspect of the scar.

    Unfortunately she was readmitted to Maidstone Hospital 10 days later with abdominal pain requiring further scans and investigations.

    At a review 2 months later, it was confirmed that there remained a symptomatic hernia present but its origin was unclear.

    Six months later the claimant had to undergo a second elective laparoscopic incisional hernia repair where the original presenting hernia was identified at the medial end of the scar and a second mesh was placed.

    Jonathan Herbert acted for the claimant and successfully claimed against the Maidstone & Tunbridge Wells Trust that the original incisional hernia repair was performed to an unacceptable standard because insufficient examination took place in theatre and the mesh was not placed in the correct position. The inappropriate positioning of the mesh resulted in the need for further corrective surgery.
