    James Cahan, specialist clinical negligence lawyer based at Thomson Snell & Passmore’s Tunbridge Wells Office in Kent, has secured compensation for the family of a mentally ill man who died as a result of a failure to provide adequate monitoring. During the investigation a nurse admitted falsifying medical records to cover up the negligence.

    This was a complex and harrowing case and involved the falsification of medical records which was exposed following a criminal investigation into the death of the patient in question.

    Falsification of a patients’ medical records is usually a very rare occurrence in clinical negligence cases and it can be very difficult to prove whether there has been a falsification without seeing the original records themselves.  Falsification of patients’ records is usually identified by spotting inconsistencies in the notes and in the case in question when the specialist solicitors at Thomson Snell and Passmore cross referenced between the patients various nursing records and clinical forms it made the falsification almost impossible to hide. To her credit the nurse responsible for the falsification did admit her actions during the inquest and we understand this has since been dealt with by the NMC.

    Following the recent revelations surrounding the Colchester NHS Trust in Essex and the criminal investigation now being carried out into the alleged falsification of cancer patients’ medical records is a clear indication that this is an area that needs to be carefully investigated, especially where any falsification has a direct adverse impact on patient safety.
