Jackson Costs Review
Lord Justice Jackson published his report on 8 May 2009 which reviews the costs of civil litigation. Phase 2, a time for discussion and consultation now follows before a final report is completed by the end of the year.
Jackson LJ is concerned that the costs in personal injury matters are high and suggests that a way to control these costs would be to extend fixed costs to these claims. He also questions whether success fees under conditional fee agreements (no win, no fee) or the insurance premium taken out to protect the client against adverse costs orders should be recoverable from the losing party and suggests more cases being funded by legal expenses insurance.
