Tomorrows People Trust Limited

Tomorrow's People Trust Limited (Tomorrow's People) is a charity which delivers training and assistance to unemployed people in order to help them acquire the skills and qualifications which will enable them to find future employment.

One of the principles underlining our relationship with our clients is our desire to establish strong links with them so that we can understand fully their business needs and, as legal advisers, the context in which our clients work and instruct us. We encourage our clients to use us as a sounding board to discuss business problems where we may be able to offer a unique view.

The example below shows how a strong relationship with a focus on approachability and speed of response meant that our clients could pick up the phone and have a quick answer to their issue, enabling them to deliver a training contract without interruption and to ensure that they did not lose a right to financial compensation.

Tomorrow's People occupied premises delivering a training scheme in London. Their lease was protected by the Landlord & Tenant Act 1954 (LTA). At the end of the tenancy, they had remained in occupation and acquired certain legal rights including the right to ask the landlord for a new lease. In the course of a business meeting, the landlord verbally told Tomorrow's People that they would soon require the premises back for their own purposes. As we have an ongoing relationship with Tomorrow's People, one of the directors simply picked up the phone to us and asked for some 'ad-hoc' advice.

We were quickly able to advise Tomorrow's People that it did have rights under the LTA and that the landlord would have to follow set procedures in order to have the premises back. The landlord then wrote to Tomorrow's People purporting to end the lease and have the premises returned. However, Tomorrow's People knew, as a result of our advice, that this letter was not effective to end the lease under the LTA. By taking further advice from us, Tomorrow's People knew the tactics to follow to remain in the premises long enough to deliver the specific training project they had started. Subsequently, when the landlord did serve the appropriate notice under the LTA, we were able to assist Tomorrow's People in responding to the notice and obtaining the financial compensation to which it was entitled.

Often straightforward advice, delivered quickly, can help to overcome critical issues. This is a good example of how ongoing and close relationships between our clients and us can be of considerable benefit. We aim to be an extension of our client's own team and act as a business partner. We are pleased that our early ad-hoc advice enabled Tomorrow’s People to manage a business critical situation to their advantage.
