Elderly clients
Our specialist team provides a complete service for elderly clients, whatever their situation.
Not all of us prepare for a situation where we cannot make decisions. The best advice is to plan ahead for the future, to know who will make decisions for you, what those decisions will be and when they can be made.
Sometimes the best laid plans go wrong. Circumstances change or relatives fall out, and there is a crisis that needs to be resolved.
Our services include:
- preparing Lasting Powers of Attorney for financial and welfare decisions as well as advance directives (living Wills)
- acting as attorneys and deputies, dealing with the day to day administration of a person's property and affairs (see Deputyship and the Court of Protection)
- advising attorneys and deputies on their rights and responsibilities
- handling applications to the Court of Protection where the court needs to make decisions or where there is a conflict
- assisting clients in a wide range of situations, whether in their own homes, in care homes or in hospital
- working across legal boundaries and involving other professionals where required.
We have one of the largest specialist Court of Protection teams in the country, offering a unique combination of expertise and resources to deal with a range of work from day to day financial management to complex care regimes for clients in their own home.
Partners act as attorneys and deputies for elderly clients who may lack capacity, or simply need someone to take the pressure off them when dealing with their finances.
Several of our lawyers are members of Solicitors for the Elderly, the largest professional advice and support network for lawyers specialising in this area of work. Martin Terrell is a vice chairman of the local group.
Martin Terrell is a joint editor and contributor to the Law Society Elderly Client Handbook. He is also the author of A Practitioner's Guide to the Court of Protection. Other members of the team contribute to Tottel's Older Client Law Service.
