Dispute Resolution

Whenever and wherever disputes arise we pride ourselves on providing reasoned, realistic advice on the routes towards resolution whilst enforcing clients' claims and protecting their rights. We will ensure full representation in the courts or at tribunals / inquiries / arbitrations whenever necessary.

We undertake a broad range of commercial, corporate and property-related litigation and arbitrations both within the UK and internationally. Where litigation can be avoided we are able to assist clients to take full advantage of Alternative Dispute Resolution, including mediation which can lead to a quick and effective settlement of disputes without resort to the courts.

Clients at all times receive advice and assistance from specialists and/or dedicated teams.

Commercial Agents
Pursuing claims against, or defending, agents where the Commercial Agents Regulations 1993 apply.

Commercial Fraud
Advising employers and employees where fraud within the workplace is suspected, or is discovered, and requires investigation or prosecution through to recovery of funds including the tracing of assets.

Company Restorations
Applications to restore companies to the Register.

Competition Law
In conjunction with our Company Commercial Department, setting up a competition law compliance programme and providing training. Also handling dawn raids or other investigations by the competition authorities and dealing with related tribunal/court cases.

Compulsory Purchase & Compensation
Advising and representing you in connection with compensation claims whether informally or in the Lands Tribunal.

Construction
Advising developers/owners, institutional funders, main contractors, specialist sub-contractors and professional consultants (whether as claimant or defendant) on all aspects of a construction dispute, including: all relevant forums - litigation (High Court (TCC) and County Court), arbitration, adjudication, mediation or conciliation; risk and cost assessment; relevant protocols; and all types of claim, including payment, defects, loss and expense, delay, contract/no contract disputes.

Consumer and sale of goods
Advising manufacturers, wholesalers, retailers and consumers on all aspects of current consumer legislation, rights and remedies.

Contentious aspects of intellectual property/IT
Includes advising on copyright, design right, patent and trade mark infringements. Also passing off and domain name disputes, and data protection issues.

Contentious Probate
We handle all problems arising out of the execution of wills and administration of estates including claims for or against beneficiaries and claims by dependants.

Contractual and Commercial Disputes
All types of dispute are handled ranging from debt-collection and consumer matters through to complex international claims.

Corporate Immigration
Includes applications for work permits and visas on behalf of businessmen/women and investors in the UK.

Defamation
Libel and slander, and the related areas of malicious falsehood, negligent mis-statement and breach of privacy/confidence.

Director Disputes and Disqualification
Includes advising and defending directors on breach of fiduciary duty claims and in disqualification proceedings, and advising and representing companies or co-directors in disputes with directors.

Environmental Law
Actions in nuisance, environmental offences, and claims relating to minerals, waste and contaminated land.

Gaming and Licensing
In particular, work for casinos and hotels, including liquor licensing.

Health and Safety
Defending prosecutions brought by the HSE and all associated investigatory work such as representation at coroners inquests and at PACE interviews.

Holiday Claims
Advising independent tour operators and agents on claims and disputes arising from consumer complaints.

Immigration
Advice and assistance on business immigration to the UK to include work permits, Highly Skilled Migrant Programme (HMSP), leave to enter and leave to remain in the UK and British nationality issues.

Insolvency
Advising on all aspects of insolvency, in particular receiverships, liquidations, administrations and all aspects of personal insolvency working closely with insolvency practitioners.

Insurance Litigation
Acting for both claimants and defendants in insurance related claims, advising on areas such as the scope of the policy and negotiating/bringing/defending claims.

Partnership & Shareholder Disputes
Includes bringing and defending minority shareholder actions.

Professional Conduct
Includes representation on behalf of professional bodies and on behalf of individuals before disciplinary tribunals.

Professional Negligence
A team of lawyers specialising in assisting those involved in bringing or defending claims of professional negligence against solicitors, barristers, accountants, architects, surveyors and financial advisers.

Property Litigation
A team of lawyers specialising in property related litigation. Both commercial and private client work is undertaken and all aspects of property litigation including the granting of new tenancies, statutory compensation, the quitting of premises, claims against tenants and on behalf of tenants including service of statutory notices, mortgage-related disputes, possession, boundary disputes, rights of way and other easements, the removal of trespassers from land as well as advice and assistance in connection with the forfeiture of leases and other remedies for breach of covenant. The team has particular expertise with regard to agricultural tenancies and commonhold / enfranchisement matters.
