Assisting a international marketing agency facilitate the exit of a sales director

This client appointed a sales director who was given wide responsibility for sales teams based in a number of European countries, and for creating a presence in the US. Unfortunately, some poor decision making on the part of this director meant that the client business soon suffered from loss of revenue and recruitment issues.

Thomson Snell & Passmore advised the client in respect of dismissing this individual, who had less than 2 years service (an therefore no unfair dismissal rights). However, the situation was particularly sensitive given that the individual suffered from a disability, arising from a heart bypass operation. After taking legal advice, this individual levelled a claim against the company which could have attracted uncapped compensation, but Thomson Snell & Passmore helped to reduce expectations and negotiate a package that was both cost-effective and furthered the client’s interests.
