The claimant was a front seat passenger in a car which was reversed by the driver from a side road into a main road in Sheffield. The car collided with a moving bus. The claimant suffered whiplash injuries with stiffness in his neck and shoulders and suffered a period of headaches. He was off work for two weeks and instructed us to act under a conditional fee agreement (no win/no fee).
The defendant’s insurance company initially admitted liability but shortly afterwards withdrew its admission and alleged that the claimant had been contributory negligent. It was alleged that he had sounded the car’s horn moments before the incident which had distracted the driver. We firmly rebutted the allegations and a full admission of liability was once conceded shortly afterwards.
Medical evidence was obtained from the consultant orthopaedic surgeon and having valued the claim we put forward an offer of settlement for the pain, suffering and loss of amenity suffered together with the claimant’s financial losses.
The case settled without the involvement of the courts.
