Claims against a former landlord by a creditor of an insolvent tenant

The Real Estate disputes team advised a long standing client who had granted a lease of premises to a printing company.  The tenant financed the purchase of printing presses through a lending facility.

Shortly after our client sold its freehold interest, the tenant fell into liquidation and its lender asserted various claims against our client relating to the cost of the storage of the printing presses following the tenant’s insolvency.

The team advised our client as to its exposure and a pragmatic commercial resolution was found without the need for court proceedings to be issued by either party.
