Compensation recovered for former power station worker diagnosed with mesothelioma

Jonathan Herbert, specialist industrial disease lawyer acting for the claimant successfully obtained an out of court settlement of £145,000 on behalf Mr M to compensate him for his pain and suffering and financial losses.

Mr M developed mesothelioma as a result of his former employer negligently exposing him to asbestos dust.  He had worked in boiler and turbine houses which were full of asbestos dust and that no steps had been taken to prevent him inhaling asbestos fibres.  Mr M was exposed to substantial quantities of respirable asbestos dust.  It was argued on his behalf that despite its knowledge of the hazards of asbestos and numerous regulations no steps were taken by the CEGB to ensure that Mr M was reasonably safe from the danger of asbestos dust inhalation during his employment with them.

A speedy resolution of the case was of the utmost importance to Mr M because he had no wife and wanted the matter resolved during his lifetime.  Liability was admitted and an interim payment of £50,000 was made.

Sadly, Mr M’s deterioration was very swift and harrowing for him.  Mr M had been traumatised by his deterioration and prognosis.  He informed paramedics who attended to him that if they could not alleviate his pain he was going to commit suicide.  Despite his claim being settled a little over three months since he instructed us, Mr M passed away three weeks after settlement was reached.
