Dispute with a subcontractor involving inconsistencies between contracts

We act for this client on a number of matters and have recently been assisting them in relation to a subcontractor re-measurement dispute that concerns the resurfacing and refurbishment works of a world famous bridge in central London.

This dispute relates to the uncertainty and inconsistencies between the measurement mechanism referred to in our client’s contract and subcontract. Also in dispute are issues arising from an informal novation of the subcontractor’s contract.

Initially, we were instructed to take steps to de-escalate the subcontractor’s imminent intention to adjudicate.

We significantly narrowed the legal issues in dispute and agreed a way forward in relation to the re-measurement exercise and valuation process, leading to a successful negotiated outcome to the matter at an early stage.
