The claimant in this personal injury claim was a 42-year-old man who was an experienced cyclist. He was cycling along a country road in Haywards Heath and was knocked off his bike and injured when a car turned left into his path giving him no opportunity to brake or take avoiding action. He suffered an exacerbation of a previous back injury, lacerations to his knee and mild psychological upset.
The case was initially started in the Road Traffic Accident portal which was introduced by the Ministry of Justice in 2010 for lower value road traffic accident claims. However, following a denial of liability by the defendant’s insurers, the claim exited the portal and continued under the normal Personal Injury Pre-Action Protocol.
The defendant’s insurers subsequently admitted liability and Lorna Buckwell and Louise Brown were able to negotiate an out-of-court settlement of this claim in the sum of £10,800.
