Removing a difficult trustee

Our firm’s trust corporation is one of the trustees of a discretionary trust set up by the settlor, i.e. the person who set up the trust during her lifetime, in favour of her adult children. The other trustee is one of the settlor’s children but that trustee is not engaging in any correspondence and relations between that trustee and the other child are strained. In our view, the best interests of the beneficiaries cannot be met. We are therefore making a court application to remove the other trustee as trustee.
