The claimant in this personal injury claim was a 16 year old girl who was struck by a reversing car in a car park as she stood stationary on her moped. The collision was very violent as the defendant hit the accelerator instead of the brake by mistake. She sustained a complicated left wrist injury which required an arthroscopy and surgical stabilisation. She also sustained whiplash injuries to her neck which caused headaches, as well as a suspected left collar bone fracture and soft tissue injuries.
The claimant was also psychologically traumatised by the accident which led her to develop post traumatic stress disorder (PTSD) and a chronic adjustment disorder, with anxiety and depression.
The claimant had been working in a stable, undertaking manual and heavy lifting work, at the time of her accident.
Jonathan Herbert took over the claim on behalf of the claimant after she had been unhappy with her previous solicitors. He instructed an orthopaedic and hand surgeon to report on the claimant’s condition and prognosis. The expert was of the opinion that the injury to the claimant’s wrist would make it more difficult for the claimant to find work as she suffered with difficulty in writing and lifting.
Jonathan was able to negotiate an out-of-court settlement of £120,000 to compensate the claimant for her injuries.
