When the relationship between co-executors breaks down

Our client was appointed as his mother’s executor along with another family member. The relationship between the executors had quickly become unworkable.

By the time that this became clear, both executors had already taken an active part in the estate so it was not possible for either of them to step down from their role. We therefore applied to the Court for an order to “pass over” both executors and appoint an independent individual to act in their place. This allowed the estate administration to progress smoothly.
