Whilst disputes over money, time and quality are often seen as an inevitable part of the construction industry, the vast majority of disputes that get as far as involving legal input are still resolved at an early stage, without resorting to formal dispute resolution processes. Our seminar will explore some key tactics to swiftly and cost effectively resolve construction disputes, whether by way of negotiation, adjudication, litigation in the specialist Technology & Construction Court (and the pre-action protocol) or by means of alternative dispute resolution. We will focus on hot topics in construction dispute resolution, including payment disputes, claims for design failings against parties with PI insurance, and how to tackle multi-party disputes. We will also give some top tips of things to look out for when negotiating the contracts, to avoid common pitfalls down the line and put in place suitable procedures for resolving any disputes that do arise.
