  • Overview

    We understand that reputation, be it for an individual or a company, is a very important asset. In this day and age of social media your reputation, which you have worked hard to establish, can easily be damaged overnight. Our team of litigators are innovative, tenacious and have the resources to help you protect that reputation. We have expertise in protecting your reputation by assisting in relation to defamation and/or bullying and harassment, whether made against you or alleged to have been made by you.

    Defamation & Privacy

    The term “defamation” covers two types of defamation actions: libel and slander.

    Both concern the publication of false material that adversely attempts to discredit a person/company’s character, credit worthiness and reputation, or reflects on a person/company’s reputation as to lower that person/company’s estimation in the eyes of other members of society.

    The distinction between the two types of defamation is that where a publication is in writing or other permanent form such as print, online or broadcasting the action is in libel. Where publication is spoken or in some other non-permanent form such as gestures, the action is in slander.

    In any defamation claim there is also the possibility of suing for malicious falsehood. This is a false statement made maliciously where the person/company making it either knew the statement was not true or did not take proper care to check.

    Libel, slander and malicious falsehood unfortunately often emanates from competitors, disgruntled employees or ex-employees and anonymous web users who resort to making defamatory statements that causes damage to reputations. In some circumstances, that damage will have a knock on effect and also cause financial damage.

    Bullying & Harassment

    Bullying and harassment takes many guises, normally involving a combination of physical stalking and/or online trolling, unwanted phone calls, letters, texts, and/or emails. The trauma that is caused by bullying and harassment can lead to tragic consequences often due to simply not knowing where to turn to make it stop, especially if the acts are made by anonymous web users.

    Our team can help with all stages of advice and representation, from the initial advice on becoming aware of a defamatory statement and/or bullying and harassment, acting to obtain any necessary urgent injunction and/or a Norwich Pharmacal Order for persons unknown, or whether a Letter of Claim/Cease and Desist letter is to be sent or replied to, through to preparation for trial and enforcement.
