  • Overview

Without a will, the rules concerning distribution on intestacy will determine what happens to your assets when you die. These may leave your dependants with unforeseen tax or other problems. This could mean that your intended beneficiaries do not inherit from your estate. It could also result in a substantial tax liability and other problems.

We can advise on all aspects of will making and succession of  assets on death including:

    • Inheritance TaxCapital Gains Tax and probate disputes
    • Inheritance Tax - efficient wills
    • Advantages of nil rate band discretionary trusts in wills for spouses or civil partners and other types of trust in appropriate cases
    • Arrangements for jointly owned property
    • Residence and domicile
    • Matters relevant to foreign nationals owning assets in the UK
    • Impact on other elements of your estate planning.

Getting married or entering into a civil partnership is usually one of the most important days of any person’s life, and the preparations can take months in advance of the big day.

    Divorce in later life

For family law solicitors who specialise in financial remedy proceedings, the phrase “each case depends on its own facts” is a well-worn adage.  This statement is perhaps so obvious as to be trivial – surely every legal case depends on its facts?  But the statement is an acknowledgement of the extremely high level of judicial discretion in financial cases arising out of a divorce.
