About the job

We are looking for an ambitious Solicitor to join our award winning and well regarded Will, Trust & Estate Disputes team.

You will be exposed to high quality and challenging matters, often of the type you would expect to find in well regarded London-based and national firms.

You’ll be part of a lively, fast-paced and innovative team in a progressive firm with ambitious growth plans, which you will play a role in helping to achieve. From the outset you will be involved in interesting, technical work and business development, supported by dynamic, approachable and experienced colleagues.

Your role will be to assist with the team’s larger disputes relating to estates and trusts, and to manage smaller disputes on a day to day basis subject to supervision. The team’s disputes typically concern the validity of wills, claims under the Inheritance (Provision for Family and Dependants) Act 1975, proprietary estoppel / constructive trust cases and disputes with (or between) executors / trustees / beneficiaries, where we are asked to act for executors / trustees, for beneficiaries, or for other family members who have not been adequately provided for under a will or a trust.

We are also currently expanding into contentious Court of Protection work, including attorney disputes and financial abuse cases. The work is challenging and rewarding, and is anticipated to grow, not just in these areas but also to support the planned expansion of the Trust & Tax Management team’s work, and of our Independent Estate Administration service. Appropriate training (including training leading to membership of ACTAPS) will be provided to equip you to undertake your work and to support your professional development.

About the team

Our Will, Trust & Estate Disputes team is highly respected. All lawyers in the team are specialist private client litigators handling only disputed will, trust and estate cases. The firm encourages ACTAPS and ConTrA membership and full participation in their events and many other events.

The successful candidate will be joining the team at an exciting stage in its development. We are now regarded as one of the few specialist teams with true expertise in this type of work outside London, with 4 team members ranked in Chambers HNW and the team ranked  Band 2 by the Legal 500.

The Head of the team and the firm’s Head of Probate were also founder members of the National Association of Independent Administrators, which counts amongst its members many of the best known firms nationally which deal with the administration of disputed estates. The volume of work that the team handles has continued to increase year on year.

About you

The ideal candidate will be a newly qualified lawyer with up to two years of experience in trusts and estate litigation.

Experience of cases related to the below would be beneficial:

  • Disputes over the validity of Wills and applications for rectification and interpretation of testamentary documents
  • Claims against executors, including applications for accounts and applications for removal and replacement of PRs
  • Disputes between executors including applications in the administration process (e.g. applications for directions)
  • Claims under the Inheritance (Provision for Family and Dependants) Act 1975
  • Applications for variation, rectification and annulment of trust documents
  • Claims against trustees, including claims for breach of fiduciary duty, and applications to remove and replace trustees
  • Claims for proprietary estoppel and constructive trust
  • Professional negligence claims arising out of private client work.
