  • Overview

    With effect from the 11 September 2017 there will be a very significant rise in compensation awards for injury to feelings or psychiatric injury in discrimination cases.

    The new Vento compensatory bands will be set as follows:

    • Lower band of £800 to £8,400 for less serious cases;
    • Middle band of £8,400 to £25,200 for cases that do not an award for less serious cases; and
    • Upper band of £25,200 to £42,000 for the most serious cases
    • More than £42,000 for the most exceptional cases.
       

    This represents a 10% increase injury to feeling awards.

    This guidance comes after a number of high profile cases called for the need to increase existing award brackets (known as Vento bands) by 10%, in line personal injury damages in civil proceedings.

    The Vento bands form part of the compensation awarded by tribunals in discrimination claims and is awarded to compensate for the hurt, upset and injury that the employee has suffered. According to today’s announcement, the bands will be reviewed again in March 2018 and annually thereafter.
