Solicitor, James Woods from our Dispute Resolution team comments on the the Supreme Court judgment of Ilott v The Blue Cross and Others.
James says, "The Supreme Court this morning has reversed the decision made by the Court of Appeal and reduced the increased award made to the daughter of the deceased.
This judgment provides further clarity on the 1975 Act and its intended purpose. The court has been clear in what it considers to be reasonable financial provision. It is important for any award in this context to be based on what is required for the maintenance of the applicant. The effect of the judgment may be to limit the size of future awards in similar claims by children and to strengthen the right of individuals to pass on their assets as they wish.”
