Advising a US based client on R&D agreements

Our US-based client has substantial farming operations in California, Texas and Florida. Our client had identified an opportunity to work with a UK grower to produce celery in both the UK and Spain.

We worked with our client to prepare an research and development (R&D) collaboration agreement during the initial stages while the parties trialled the plant varieties to establish whether they were suitable for production in the UK and Spain.

On completion of the R&D project, and registration of the plant variety rights, we prepared, negotiated and advised on the vegetable production licence.
