Advising on conflicting negotiations in the development of a sports hall complex

We advised on the construction documentation required for the development of a new sports hall complex. Whilst the nature and scope of the development itself was not particularly unusual or complex, negotiations with the contractor, a well known major construction group, required careful handling.

During negotiations in which terms would be agreed, documents altered accordingly and then a different individual within the contractor would then renege on the agreement (thus requiring further negotiations, alterations and agreement), we worked to keep our client’s position protected. In particular, when dealing with agreement as to the principle of, and the amount and basis of, the contractor’s liability and limitations on that liability, we ensured that any agreed limitations were sensible and provided sufficient protection for the client against potential major defects.
