Subsequently appointing administrators over the borrower’s company to finish the development and provide a better return to the primary lender (amongst other creditors).

One tenant operated a business where it would offload goods and materials from ships/boats. The tenant went into voluntary liquidation and vacated the site, although it left behind a barge containing thousands of pieces of equipment, large metal rigs, a 40ft crane, a JCB digger, office cabins and containers amongst other things.

We inspected the site and investigated the possible ownership of the remaining items. We served notices under the Torts (Interference with goods) Act 1977 on various companies that may have had an interest in the items. After a period of several months, the items left behind by the tenant and by the liquidator were removed from the client’s land.

The matter went before the High Court who determined the client had successfully terminated their lease.

We successfully negotiated a compromise whereby the client completed the purchase of the property but as a reduced price.

We compromised the tenant’s claim and subsequently issued possession proceedings. Those proceedings were defended and the tenant alleged she had paid a deposit which was not protected. We managed to obtain an order for possession and enforced the order for possession by instructing County Court bailiffs to attend the property and evict the tenant.
