Mr C was riding his bicycle in a cycle lane on St John’s Road, Tunbridge Wells, Kent, while the defendant was travelling in the same direction in slow moving traffic. Without warning the defendant pulled out of the queue of traffic in order to turn left into a car park. The defendant pulled in front of Mr C causing him to crash into the side of the vehicle.
Mr C suffered a fracture to the neck of his right humerus (upper arm) and multiple soft tissue injuries to his right shoulder and right arm and right thigh (with permanent scarring on his right shoulder, right arm and right thigh). An expert plastic surgeon reported that the appearance of some of the scarring could be improved with surgery. Mr C also suffered anxiety displaying as avoidance to resume regular cycling.
Liability was admitted and the defendant agreed a settlement without the need for court proceedings to be commenced.
