Enforcing the terms of an inter-creditor deed

A second charge holder attempted to take action against the mutual borrower in breach of the terms of an inter-creditor deed that would have prejudiced the ability of the borrower to build out the site.

Mark Steggles advised the lender client as to its options and managed to persuade the second charge holder not to take action thereby enabling the planned development to proceed.
