Purchase of a property on a private road with no legal right of way

The clients were purchasing their dream family home in order to be close to family. As such, they were set on purchasing the particular property in question.

To complicate matters, the property is located on a private road. This means that any expenses associated with the maintenance of the road would likely be incurred by those who have rights of way over it.

This was further complicated by the fact that the property did not have ay legal right of way over the private road abutting the property.  The team, led by Rebecca, picked up on these issues very early on in the transaction to the benefit of the client. Rebecca was able to agree with the Sellers that the client enter in to new easements which established clear parameters on these arrangements.
