The Real Estate disputes team acted for a large organisation of which hundreds of private member clubs through the UK are members. The team acted in connection with the successful challenge to an administrator’s plans to distribute Club funds after the Club fell into administration and the Club’s property was sold. The team’s experience with the application of our client’s Club rules and its ability to move quickly meant that a challenge was presented in time before any distribution was made.
The case was of particular importance to our client as it set a helpful precedent in the event of future conflicts with administrators or liquidators concerning the interpretation of our client’s model form rules in the event of an insolvency event arising. Our client also recovered its costs in connection with the application.
The funds have been returned to our client and have been reinvested in other member clubs.
